And they're suing the police officer who fired the shot that killed their son... not an entity... for that $120-million. They're also naming the town as a co-defendant.

DJ Henry's parents claim in the lawsuit that say the Pleasantville, New York police officer Aaron Hess violated the civil and constitutional rights of their son, Danroy Henry Jr., and they now are demanding compensation for their son's death and their suffering.

BREAKING: No Police Indictment In DJ Henry Shooting

A New York state grand jury has found there was no crime in the police killing of a college football player.

The Westchester County ((NY)) DA's office said that jurors found no "reasonable cause" for an indictment in the death of DJ Henry.

Henry's father had demanded a murder indictment against the officer who acknowledged shooting his son. The father says there "are no words to express" his disappointment. He is now calling for a federal investigation.

Henry was a football player for Pace University. He was killed back on October 17th when officers fired at his car as he drove away from a bar, and toward police as they maintain, which caused them to fire at the vehicle.

Police had been called to a disturbance outside of a bar after the Pace homecoming game.

DJ Henry's Dad Testifies To Grand Jury

The father and the best friend of a college football player killed by police in New York state testified before a grand jury.

Danroy Henry, Sr. said after his testimony that he did not like having to talk about how his son died... rather how he lived.

Danroy ((DJ)) Henry Jr. was killed back on October 17th when officers fired at his car outside a bar in the New York City suburb of Thornwood. Police had been called because of a disturbance that left the bar and ended up outside.

A Westchester County ((NY)) grand jury is investigating, and there is no word on when their opinion will be returned.

Henry's friend Brandon Cox was in Henry's car, wounded in the shooting, and also testified in front of the grand jury.

DJ Henry Family Planning Lawsuit

The Massachusetts family of a Pace University football player killed by police is starting the engine on a possible lawsuit against the police officers that the family feels are responsible for the shooting.

The Henry family lawyer Michael Sussman says that he has filed notice of a $120-million claim against the town of Mount Pleasant and the village of Pleasantville.

Municipal officials did not immediately return phone calls.

Danroy ((DJ)) Henry, was killed October 17th after police were called to a disturbance that was outside of a bar in the town of Thornwood, New York.

He was shot through the windshield of his car as he was behind the wheel. Eyewitness accounts of the shooting are quite different from one another, and a grand jury is investigating the case.

Sussman alleges that the police officer committed murder with his gunshot through the driver's window, but the officer's lawyer said he was thrown onto the hood of the car when Henry ran into him and he had no alternative.

Autopsy results revealed that Henry had a BAC above the legal limit for driving in the state of New York. Sussman disputes that finding as well.

The notice of claim alleges that the two New York towns that had officers on the scene were negligent in hiring and the training officers and that all of the officers were negligent when they used deadly force.

The $120 million figure in the notice of claim, Sussman says, reflects "the family's valuation to the extent they can give any monetary valuation" of their son's worth.

DJ Henry Found With Fake ID, 4 Pace Teammates Plead Not Guilty

The revelation above really seems to be more of a red herring than anything else...

Pace University footballer DJ Henry's dad is still calling for a Department of Justice investigation into the shooting death of his son outside a nightclub a few weeks ago.

Some accounts of the evening have Henry ramming two Pleasantville, New York police officers with the car he was driving, but others are openly disputing the claims of the police officers from the night in question.

Fox 5 learned Henry was carrying a fake ID when he was shot. The correlation of that to the events of the 17th is unclear at present.

Four of his teammates were arrested and charged with disorderly conduct and resisting arrest during the events of October 17th. The players pled not guilty, and their attorney asserted that the officers at the scene used excessive force.

"These young men are innocent and it's outrageous to ask them to come back here to a criminal court," attorney Bonita Zelman said.

Slain Pace FB Player Has Funeral On Birthday

At least 1,000 people are expected at the funeral of Pace University football player DJ Henry, including Massachusetts Senator Scott Brown and DJ's Pace University football teammates. DJ's father says he's looking forward to the service.

Henry was killed two weeks ago when police officers fired at his car outside a bar in the town of Thornwood, New York, near the school itself. Police say they were forced to shoot after DJ drove his car at officers. But witnesses have said Henry was simply trying to move his car out of a fire lane and was no threat.

The Henry family questions the use of deadly force and how he was treated after he was shot. A thorough investigation is underway.

Lawyer Says Paramedics Ignored Pace FB Player After Shooting

U.S. Sen. Scott Brown ((MA)) is calling for a "thorough" investigation into the shooting death of a Pace University student who was shot and killed by police in New York last weekend.

The senator said on local radio that 20-year-old Danroy "D.J." Henry was a "designated driver" and was at the local bar to pick up friends.

Police say Henry hit two officers early Sunday with his car after an officer knocked on his window. But a passenger's father denies an officer was hit and said Henry thought he was obeying police.

Sussman, in a subsequent interview, said that a friend of DJ's left the car on his own, but upon realizing Henry was shot, tried to get him medical attention.

One Pace player knew CPR, according to another attorney representing the Pace players in the car, but he was told to stay away.
