A California judge has rejected a bid for a change of venue for the trial of the suspected drunken driver accused of killing of Los Angeles Angels pitcher Nick Adenhart and two others.
Orange Count Superior Court Judge Richard Toohey denied the motion by defendant Andrew Thomas Gallo's defense attorneys. The judge says Orange County has millions of residents and a fair jury can be found.
Gallo is charged with three counts of second-degree murder in the deaths of Adenhart and friends Courtney Stewart and Henry Pearson.
Police say Gallo's blood-alcohol level was almost three times the legal limit at the time of the April 2009 crash in the town of Fullerton, California. Adenhart was out with friends after pitching six scoreless innings against the Oakland Athletics in nearby Anaheim in his major league debut for the club.
The trial is still slated for later this month...
"The nature and gravity of this case is that it is uniquely tied to the geography of this county," Gallo's attorney Jacqueline Rubio said. "It's definitely possible" to get an impartial jury, she added, but "all we are saying is we can't be certain."
Here's a story from a year ago when Gallo initially pled not guilty...

By the way, you still can't get an Adenhart jersey, but you can get one with Gallo and his BAC level from shop.mlb.com.
If Gallo is convicted of all charges, he could serve more than 50 years in prison.
The HQ can only hope...
